Murder of Anwar Al-Awlaki; Slaughter of the Constitution

President Barak Obama grandly announced that a CIA drone attack had killed Anwar Al-Awlaki in Yemen along with Samir Khan, the editor of his website. “This is further proof that al Qaeda and its affiliates will have no safe haven anywhere in the world,” Obama said. The Press dutifully reported the announcement, some joined in the celebrations of having gotten another terrorist but nobody questioned the methodology that resulted in ending not one, but TWO American citizens’ lives.

Who cares? We got another one! Someone should care, certainly I do.

They were murdered.

The time is nigh when a US citizen can be murdered by a simple, Presidential edict and nobody dares ask how such an event can come about. We have a Congress of 535 Representatives and Senators who dared not speak out. We have NINE judges in the US Supreme Court who joined in the patriotic conspiracy to protect America and rendered themselves mute.

Patrick Henry said, “The Constitution is not an instrument for the government to restrain the people, it is an instrument for the people to restrain the government - lest it come to dominate our lives and interests”. It would appear that none of these men and women have read or understood the constitution that they swear to uphold and defend as their oath of office, let us review:

Article III reads in part: “The trial of all crimes except in cases of impeachment shall be by jury”…and “No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court“.

The Fifth Amendment: “No person shall be held to answer for a capital or, otherwise infamous crime, unless on a presentment or indictment of a grand jury except in cases arising out of land or naval forces, or in the mutiny, when in actual service in time of war or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb, nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty or, property, without due process of the law; nor shall private property be taken for public use without just compensation”.

The Sixth Amendment: “In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial by an impartial jury…and to be informed of the nature and cause of the accusation; to be confronted with witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense“.

Neither Al-Awlaki nor his editor, were accorded any of these constitutional rights. The President- Emperor signed the kill order and so it was done.

I am sure if I said this extra-constitutional act occurred because Al-Awlaki and his editor Samir Khan, were both Muslim, people would line up to tell me I am being paranoid; I am sure by calling their killings, Murders, I am open to condemnation as an Al-Qaeda-loving, terrorist myself so, let us clear the table of some misconceptions.

Call Al-Awlaki a criminal, accuse him of inciting violence against the United States and I will not argue with you…heck, call him a terrorist and I will not argue because I don’t care what the accusations against him and Samir Khan were.; the constitution of the United States does not permit the killing of an American citizen (or a non-citizen, for that matter) without due process of the law or, without proper evidence.

To be sure, if there is an active battle going on and someone on the other side is a US citizen, he can be shot and killed…IN THE BATTLE! But there is no way anyone, let alone the President of the United States, can sign a death warrant for an American citizen, without first charging him, giving him the right to defend himself and having him found guilty by a jury in open court. THAT, is what this discussion is all about; everything else is a tangential distraction.

Why do I say this could not have been allowed to happen if the target had not been a Muslim? Judging by recent events, it appears that America does not care about the constitutional rights of Muslims because this is not the first time the constitution has been trashed in order to attack Muslims.

Over 14,000 American Muslims have been held in prisons (“Detained”) for weeks, months and years, without charges or trials and then released without explanations or apologies; at least on American Muslim is still under “detention” since 9-11…still without charges or trial.

 An American Muslim, Yaser Esam Hamdi, was imprisoned in Guantanamo and was released on conditions that he renounce his birthright US citizenship. On top of that, he was also forced to renounce all rights to ever reclaim his US citizenship or, (per article 13 of the “agreement”) “…for any and all claims for any violations of foreign or international law arising from acts or omissions occurring prior to the official date of this agreement…”.

American Muslims have been put in special prisons like Camp X-Ray in Guantanamo…without charges or trials where they have been tortured. In order to avoid the need for charges and trials, President George Bush established special Military courts that operated on special orders to find the accused guilty and only to find him guilty. There were no rules of court or trial, the “judges” were untrained military officers (one was even unfamiliar with the Geneva Conventions), the accused were often not informed of the charges, no evidence was presented and in some rare cases, where even the blinded judge could not find the accused guilty, the prisoners were returned to the same courts for “re-trials”…as many as three times, until the judges got the hint and found them guilty.

It is noteworthy that candidate Obama condemned the Guantanamo prison, promising to shut it down, but President Obama is keeping it open.

American Muslims have been tortured by Americans, as well as by foreign countries at the behest of Americans. Sometimes, the actual torture and interrogation abroad, was overseen by our own securityservices.

American Muslims have been forcibly taken to foreign countries from the US or, have been abducted from overseas and taken to obliging countries for torture and “enhanced interrogations”.

These are simply the extra-constitutional abuses that Muslims have been subjected to. Apart from these, there are dozens of other institutional abuses that are continuously heaped upon Muslims in the name of “security”, that no one dares question…because Muslims are the target of such abuses.

Muslims have been humiliated repeatedly by being taken off flights (sometimes in handcuffs) simply because some REAL American (White and non-Muslim) voiced “discomfort” at the prospect f sharing the same flight with “Muzlems“…say no more! the “Muzlems” are gone!

The different security agencies of America…Police, FBI, ATF, CIA, the Military, even the ASDA…are continuously being trained to regard Muslims as the greatest threat to the United States and to the West, tens of millions of dollars are spent each year, to keep these defenders of the nation, kill-ready when they see Muslims.

Part of the fault lies with Muslims because they are completely disengaged from governmental facets of American life. Hardly any feel comfortable enough to join the security forces and few if any work for politicians as interns of staff. Small wonder then, that those who speak against Muslims have a voice that is heard while from Muslims, there is silence.

Even so, it is not a capital crime to remain disengaged and even so, our political leaders and our security forces are sworn to uphold the constitution…but nobody seems to recall what it says and America continues to remains a silent partner in the destruction of its own constitution. I fear the murders of Anwar Al-Awlaki and Samir Khan are only a foreshadow of what the future holds for us, for ALL of us.

    • Expediency has no rules or law, but if you wish to live in a JUST society, you have to have rules and laws that apply to everyone, regardless of situation.
      Our contitution is there to control the rulers and to protect the people…the worst of the people. Neither the constitution not any laws are of any use if they cannot protect the worst amongst us anfd in the worst of times. If we do not speak out or, fight for our rights continuously then we should not be surprised if one day we wake up to being the targets of expediency (“neccesity”) ourselves.
      The consitution not designed for enjoyment at beach parties.

    • First of all, your comment has absolutely nothing to do with my essay. I am not at all, defending Al-Awlaki, I am attacking to total lack of consideration for the US Constitution…that every politician and civil/military servant swears to uphold and defend; you should read it sometime. Article 3 section 2, 5th Amendment, 6th Amendment, 11th Amendment…ALL protect the right of a citizens (or resident in the US, legal or not) against unilateral punishment and in supports of Due process of the law under the constitution.
      Secondly,I believe you are simply venting your spleen against Islam without knowing or understanding anything about it at all. I highly suggest you read Rabbi Reuven Firestone’s “Introduction to Islam for Jews”, I suggest this book because it is written by an emminent scholar who is not a Muslim so, even cynics like yourself should not be able to dismiss it lightly.
      Thirdly, the quote is from Imam Ali, not the Prophet Mohammed and it refers to a piece of paper of indeterminate origins.
      Fourthly, no source of information INCLUDING the Hadith, may be considered as valid if they contradicts the Quran and this one does.
      Finally, I’ll lay heavy odds that you have no idea what “infidel” means in the Quran except for some fantasy that has been fed to you by some fear-monger.
